1. Introduction & Acceptance
Plan58 (plan58.co.uk) is an independent platform providing interactive financial simulation tools covering specific areas of UK personal finance.
Plan58 also operates a B2B subscription service through which financial advisers, accountants, and other professionals (each a “Subscriber”) may display Plan58 calculators on their own websites via iFrame embeds (collectively, the “Lead Capture Services”).
By accessing or using the calculators, interactive models, and visual simulators on this domain, or by registering as a Subscriber and accepting these terms via the customer portal, you (the “User” or “Subscriber”) confirm that you have read and understood these Terms of Service (the “Terms”) and agree to be bound by them. Plan58 logs the timestamp of this acceptance. If you do not agree, you must stop using the Services immediately and, if applicable, cancel your subscription.
References to “Plan58”, “we”, “us”, or “our” refer to the operator of plan58.co.uk. Plan58 is a trading name of Dominic Wilkinson, operating from the United Kingdom.
2. Non-Advisory Status & FCA Perimeter
Plan58 is not a financial services company, investment platform, or regulated advisory entity.
No Regulated Activity: Plan58 is not authorised or regulated by the Financial Conduct Authority (FCA). We do not provide regulated financial advice, investment management, tax planning, or personal recommendations within the meaning of the Financial Services and Markets Act 2000 (FSMA).
No Client Relationship: Access to these tools does not establish an advisory relationship, intermediary relationship, or fiduciary duty between Plan58 and any User.
Illustrative Purpose Only: All calculations, simulations, and outputs generated by Plan58 are intended strictly for educational visualisation and personal scoping. They do not constitute a financial promotion, endorsement, recommendation, or validation of any financial strategy.
Independent Responsibility: You are entirely responsible for your own financial decisions. We strongly recommend consulting a qualified, FCA-regulated Independent Financial Adviser (IFA) before executing any financial action based on outputs from these tools.
Subscriber Regulatory Responsibility: Where a Subscriber uses the Lead Capture Services to generate leads via an embedded widget, the Subscriber, not Plan58, is solely responsible for the regulatory status of that interaction. Plan58 assumes no advisory, fiduciary, or intermediary role in respect of the Subscriber’s end-clients.
By configuring a Lead Capture tool, Subscribers must declare their regulatory status. Subscribers confirm and warrant that:
If declaring as FCA Regulated: All company names, regulating bodies, and registration numbers (e.g., FRN) provided to Plan58 are accurate, actively held, and legally authorise the Subscriber to operate.
If declaring as an Unregulated Entity: The Subscriber does not hold professional authorisation and agrees they will not use Plan58 Lead Capture Services to offer regulated financial advice or communicate unauthorised financial promotions in breach of Section 21 of the FSMA.
Automated Verification Protocol: To generate dynamic compliance transparency footers, Plan58 utilizes an automated verification protocol. For Subscribers declaring FCA-regulated status, we cross-reference the provided Firm Reference Number (FRN) against the FCA register API and require successful authorization via an email address matching the firm’s registered web domain.
While Plan58 implements these technical safeguards to verify professional registration, the Subscriber remains solely and ultimately responsible for the accuracy and legality of their regulatory declarations. Plan58 relies on third-party data (e.g., the FCA API) which may be delayed or inaccurate, and we accept no liability for Subscriber misrepresentation, domain spoofing, or fraudulent use of the platform. False regulatory declarations, or attempts to circumvent the verification process, will result in immediate account termination without refund.
3. Mathematical Principles & Deterministic Limitations
The Plan58 calculators are deterministic linear utility models. To use them effectively, you must understand their constraints:
User-Defined Inputs: The tools function as a mathematical canvas. The accuracy, validity, and relevance of any output depend entirely on the inputs you choose to enter. Plan58 does not validate or challenge the assumptions you apply.
No Stochastic Modelling: Unless explicitly stated, the simulations perform static arithmetic only. They do not account for Sequence of Returns Risk (SORR), market volatility, or future changes to UK tax legislation or allowances.
Estimation Disclaimer: While we strive to ensure formulas are structurally sound, all outputs are estimations only. We do not guarantee 100% accuracy. Do not rely on these outputs for precise financial tracking, tax reporting, or auditing.
Past Performance: Any historical market metrics referenced are for illustrative context only. Past performance is not a reliable indicator of future returns.
4. Lead Capture Services (Embeds)
This section applies to Subscribers utilising our Lead Capture Services across our defined subscription tiers.
Subscription Tiers:
Free Tier: Permits unlimited embeds on one registered domain and one sandbox testing domain. Free tier embeds strictly mandate the display of a Plan58 backlink. Lead capture functionality is disabled.
Pro Tier: Permits embedding and lead capture routing on up to 3 registered domains. Removes mandatory Plan58 backlinks and allows basic brand customisation.
Growth Tier: Permits embedding and lead capture routing on up to 10 registered domains.
Domain Registration & Ownership: Subscribers warrant that they own or are authorised to use any registered domain.
Dynamic Compliance Footers: Plan58 automatically generates a compliance disclaimer footer on Lead Capture tools based on the Subscriber’s verified regulatory profile. Subscribers may not attempt to hide, alter, or manipulate this dynamically generated footer via custom CSS, scripts, or any other means.
Service Availability: We provide the Lead Capture Services on an “as is” and “as available” basis and accept no liability for downtime or performance degradation.
5. Subscriber Obligations
By registering as a Subscriber, you agree to:
Provide accurate account information and maintain truthful regulatory compliance declarations within your portal.
Use the Embed Service only on domains you own or are authorised to use.
Complete the automated domain-email verification loop to authenticate any declared professional registration status.
Not misrepresent Plan58 calculators as your own proprietary software, nor attempt to obscure or edit the Plan58 dynamic regulatory compliance footers.
Maintain a compliant privacy policy on your own website, clearly disclosing to your visitors that contact details submitted via the lead form will be shared with you as the Data Controller.
Comply with all applicable laws, including UK GDPR, in respect of visitor data collected.
Not use the Lead Capture Services to issue unlawful financial promotions, or capture leads for fraudulent or unregulated investment schemes.
Not sub-licence, resell, or grant third parties access to the Lead Capture Services without Plan58’s prior written consent.
6. Subscription, Payment & Cancellation
Billing: Pro and Growth subscriptions are billed on a recurring basis via Stripe. Payment card data is processed exclusively by Stripe; Plan58 does not store card details directly.
Pricing Changes: Plan58 reserves the right to modify subscription pricing. For existing subscribers, we will provide at least 30 days’ advance notice via email.
Cancellation: Subscribers may downgrade or cancel at any time via the customer portal. Cancellation takes effect at the end of the current billing period.
Effect of Cancellation: Upon expiry or cancellation of a paid tier, Lead Capture tools on the Subscriber’s registered domains will automatically revert to Free tier functionality. This includes the re-display of Plan58 branding and the immediate disabling of lead routing. No refund will be issued for any unused portion of a subscription period.
Suspension & Termination: Plan58 reserves the right to suspend or terminate a Subscriber’s account without prior notice if the Subscriber is found to be in material breach of these Terms.
7. Subscriber Data Handling & Privacy
Zero Financial Data Policy: Plan58 is engineered to protect end-users and minimize Subscriber liability. Under no circumstances are the financial inputs, simulation parameters, or calculated outputs of a visitor stored on Plan58 servers or transmitted to the Subscriber. All financial modelling occurs strictly client-side in the user's browser.
Lead Data Routing (Webhook & Email): When a visitor submits a lead form via a Pro or Growth tier embed, Plan58 routes only the basic contact information (e.g., name, email, phone number), the calculator name, and relevant UTM/tracking parameters to the Subscriber.
Transient Processing: Lead routing is processed via a secure, server-side transient relay. Plan58 does not write, log, or persist the webhook JSON payload or email content to any database. The payload is securely forwarded to the Subscriber’s endpoint and immediately destroyed from server memory. Email delivery logs are retained for a maximum of 30 days for reliability diagnostics before permanent deletion.
Application Logging Limits: To maintain a strict privacy environment, Plan58’s server-side diagnostic logs are hard-coded to ignore payload contents. System logs record only the originating domain, timestamps, and programmatic exception types.
Subscriber as Data Controller: When operating the Lead Capture form, the Subscriber acts as the Data Controller for visitor personal data. Plan58 acts strictly as a Data Processor to the limited extent of executing transient technical relays for contact information.
Full Privacy Policy: The Plan58 Privacy Policy, available at plan58.co.uk/privacy-policy, is incorporated into these Terms by reference.
8. Intellectual Property & Permitted Use
Plan58 owns all intellectual property rights in the software architecture, user interfaces, visual design, and custom mathematical logic powering the platform.
Visitor Licence: Individual visitors are granted a personal, non-exclusive, revocable licence to use the calculators in their web browser for personal, non-commercial financial modelling.
Subscriber Licence: Subscribers are granted a limited, non-exclusive, non-sublicensable, revocable licence to display the calculators solely via the official Plan58 mechanisms provided within their respective tier limits.
Prohibited Actions: You may not: scrape, reverse-engineer, decompile, or reproduce the underlying logic or mathematical models for commercial purposes; reproduce the Plan58 interface; attempt to circumvent the verification systems; or sub-licence the service to third parties.
9. Limitation of Liability
Visitor Limitation: To the maximum extent permitted by UK law, Plan58 accepts no liability for any direct, indirect, incidental, or consequential financial losses arising from the calculators. This includes shortfalls in retirement income, unexpected tax liabilities, or opportunity costs.
Subscriber Limitation: Plan58 accepts no liability for: downtime or degradation of the Lead Capture Services; failure to deliver lead notifications arising from Subscriber misconfiguration or third-party endpoint failures; data loss resulting from Subscriber infrastructure; or any regulatory consequence arising from a Subscriber’s use of Plan58 tools with their clients.
“As Is” Provision: The Services are provided “as is” and “as available” without warranties of any kind.
10. Modifications to These Terms
For Free Users: Plan58 reserves the right to update these Terms at any time. Continued use of the Services constitutes acceptance.
For Paid Subscribers: For material changes affecting pricing, feature availability, or data handling, Plan58 will provide at least 14 days’ advance notice via email. If a Subscriber does not accept a material change, they may cancel before the change takes effect. Continued use after the notice period constitutes acceptance.
11. Governing Law & Jurisdiction
These Terms and any dispute arising from the use of the platform shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction.
